This privacy policy applies to the Countless app for mobile devices, together with any related services operated by Raitis Šaripo (collectively, the "Application"). Raitis Šaripo is hereby referred to as the "Service Provider".


What stays on your device

Countless is designed to work without an account. Your push-up sessions and the individual reps within them, your totals, streaks and personal records, your challenges and achievements, the body weight you enter, and your settings are stored on your device, in the Application's own local database.

None of this content is sent to the Service Provider. There is no Countless account, and the Service Provider cannot see how many push-ups you do, when you did them, or what you weigh. The only exceptions are described in the sections below.


No accounts and no cloud sync

The Application does not ask you to register, sign in, or provide a name, email address or phone number. It has no server of its own, and your session history is not synced or backed up to the Service Provider. Your data lives on the device it was recorded on, and it travels with that device's own iCloud or iTunes backup if you have one, which is handled by Apple under Apple's Privacy Policy. Deleting the Application deletes the data it holds.


Motion from your headphones

Countless counts your push-ups by reading the motion sensor in compatible headphones, such as AirPods, using Apple's Core Motion framework. iOS asks for your permission before this can start, and you can withdraw it at any time in the iOS Settings app under Privacy & Security → Motion & Fitness.

Motion is processed live on your device, entirely within the Application, and is used only to decide when a rep has happened. The raw motion stream is not recorded, not stored, and not transmitted anywhere. What remains after a set is the count itself and the timing of each rep, saved locally as described above. The model name of the connected headphones is used to show which device is counting; see "Information Collection and Use" for the one way it is also included in analytics.


Audio and haptics

The Application plays a short tick into your headphones at the bottom of each rep, and can vibrate your phone. To keep counting reliably while your screen is off or the Application is in the background, it holds an active audio playback session. The Application does not use the microphone, does not record audio, and does not listen to anything.


Apple Health (optional)

Countless can save each finished session to Apple Health as a workout. This is off until you turn it on in Settings, iOS asks for your permission separately, and you can turn it off again at any time.

Information Collection and Use

The Application collects analytics and crash information when you download and use it, in order to find bugs and understand which features are used. This information may include:

Analytics events record which action happened — for example that a session started, that a session was ended manually, or that a purchase was completed — and never how you performed. Your rep counts, session durations, session times, records, streaks, challenges and body weight are not included in analytics or in crash reports. This is enforced by the Application's structure rather than by policy alone: the fixed list of events it is able to send has no room to carry such a value. Crash reports likewise carry the name of what the Application was doing, not the numbers involved.


Cookies and tracking technologies

The Application or its third-party SDKs may use cookies, SDKs, pixels, and similar technologies to support functionality, analytics, or service delivery. Where required by applicable law, the Service Provider will obtain consent before using non-essential tracking technologies.

Countless does not collect the Advertising Identifier (IDFA) or the Identifier for Vendor (IDFV), does not link the advertising framework, does not display advertising, and does not track you across other companies' apps or websites.


Your Rights

You may request access to, correction of, or deletion of your personal data held by the Service Provider. To exercise these rights, or to withdraw consent where processing is based on consent, contact the Service Provider at saripo.raitis@gmail.com.

Please note that content stored only on your device, or in Apple Health, is under your control rather than the Service Provider's: you can delete individual sessions in the Application, delete everything by deleting the Application, and remove what was written to Health in the Health app.


Your California privacy rights (CCPA/CPRA)

If you are a California resident, you have the right to know what personal information is collected, the right to delete personal information, the right to opt out of the sale or sharing of personal information, and the right to non-discrimination for exercising these rights. The Service Provider does not sell your personal information.

The Service Provider may use the information you provide to send important information, required notices, and, where permitted by law, marketing communications.


For a better experience while using the Application, the Service Provider may require you to provide certain personally identifiable information. The information the Service Provider requests will be retained and used as described in this privacy policy.


Third Party Access

The Application uses a small number of third-party services, listed below. Analytics and crash data transmitted to them is limited to the information described under "Information Collection and Use", and does not include your session content. The Service Provider may share your information with third parties in the ways that are described in this privacy statement.


International Data Transfers

The Service Provider or its third-party service providers may transfer personal data to countries outside your country of residence, including outside the European Economic Area (EEA). Where applicable law requires safeguards for international transfers, the Service Provider will use appropriate mechanisms.

Data protection laws in other countries may differ from those in your jurisdiction. Where required by law, the Service Provider will apply appropriate safeguards and obtain any consent required for the transfer.

Purchases

Countless Pro is an auto-renewing subscription sold through Apple. Payment is handled by Apple and the Service Provider never receives or sees your payment details. Whether you are subscribed is determined on your device from Apple's own signed transaction records; there is no purchase account or server held by the Service Provider, and restoring a purchase on another device is handled by Apple.


Opt-Out Rights

You can stop further collection of information from your mobile device by uninstalling the Application. Uninstalling will stop the Application from collecting data from your device, but it does not automatically delete information that has already been transmitted to the Service Provider or to third parties. Uninstalling does not remove workouts the Application already wrote to Apple Health; delete those in the Health app.

Data Retention Policy

Please note that some User Provided Data may be required for the Application to function properly.


Children

The Application is not intended for children under 16 years of age, or such higher age as required by applicable law. The Service Provider does not knowingly solicit data from children or market the Application to them.


Where parental or guardian consent is required under applicable law, the Application is not intended for use without that consent. The Service Provider does not knowingly collect personally identifiable information from children under 16 years of age in violation of applicable law. In the event the Service Provider discovers that a child has provided personal information, the Service Provider will immediately delete this from their servers. If you are a parent or guardian and you are aware that your child has provided the Service Provider with personal information, please contact the Service Provider (saripo.raitis@gmail.com) so that they will be able to take the necessary actions.


Health and fitness disclaimer

Countless is a fitness tracking tool, not a medical device. Its rep counts and its estimate of energy burned are approximations produced by a motion sensor and should not be relied on for medical purposes or treated as medical advice.


Security

The Service Provider is concerned about safeguarding the confidentiality of your information. The Service Provider provides physical, electronic, and procedural safeguards to protect information the Service Provider processes and maintains. Your session history is held in the Application's own container on your device, protected by the device's file encryption, and is not reachable by other apps.


Data Breach Notification

If a data breach occurs that affects your personal data, the Service Provider will notify you in accordance with applicable legal requirements, including, where required, providing information about the nature of the breach and the steps being taken to address it.


Changes

The Service Provider may update this Privacy Policy from time to time. The Service Provider will notify you of material changes by posting the updated Privacy Policy with an effective date. Where required by law, the Service Provider will seek your consent to material changes before they take effect.

Your Consent
